About the Author:

Laurel Loomer began her career as a dental hygienist and later became a Registered Dental Hygienist in Alternative Practice before pursuing a law degree and earning her law license. From 2011 to 2020, Laurel taught Dental Law and Ethics in an RDA program. During her teaching experience, she recognized the need for a more effective study guide to help students pass the exam. She found that the four-hour course provided insufficient time to cover all the necessary information, and existing study guides were filled with legal jargon, lacking clear explanations in plain language. Laurel believed that RDA applicants would better understand and retain the laws if presented with descriptions and illustrations. She also recognized the importance of including a practice test with answers and explanations to equip students with the knowledge needed to succeed on the exam.

Scope of Competence BPC § 1684

In addition to other acts constituting unprofessional conduct under this chapter, it is unprofessional conduct for a person licensed under this chapter to perform, or hold himself or herself out as able to perform, professional services beyond the scope of his or her license and field or fields of competence as established by his or her education, experience, training, or any combination thereof.

This includes, but is not limited to, the use of any instrument or device in a manner that is not in accordance with the customary standards and practices of the dental profession. This section shall not apply to research conducted by accredited dental schools or colleges, or to research conducted pursuant to an investigational device exemption issued by the United States Food and Drug Administration.

This statute restates the rule that it is misconduct to act outside the scope of the license. It goes on to spell out that using some devices or administering some drugs is acting outside the scope of the license. An example might be an RDA administering nitrous oxide. Another example is a general dentist administering general anesthesia.

The RDA or DDS is, in effect, claiming to have a different license simply by the act of administering the drug. The RDA is not competent to administer N2O, and the DDS is not competent to administer general anesthetics because neither has the license to do so. Any use of a drug or device that the person is not licensed to use is holding himself as able to perform a service that is beyond the scope of his license. The rule has an exception for students in dental schools and research conducted under an FDA exemption.
